I don't know why you are having the problems you are. I have almost never had problems with fleet mining. I have even picked up abandoned ships at spawn on a MP server and added then to my mining fleet.

No set rules as far as pvp is concerned but it tends to be via mutual consent.
It is a survival server however and not a creative one so you will have to work at it.
